Trying to dl the beta right now but it is stuck on "Updating setup files", and has been for about 5 minutes. I remember reading something before about some agents or something a while back but can't find the threads and not sure if that's my problem. Any solutions?
I had problems with this issue myself. After trying all of the options posted to no avail, I started fiddling with it myself. What I did:
Run launcher, it'll stick at 60%
Open Task Manager and Kill Agent.exe
Open C:Program Data/Battle.net/Agent/Agent.868
Run Agent.Exe from this folder before it restarts itself in task manager (A DOS window will appear, let it run all the way, it will close itself)
Once it finishes, the Launcher will die.
Re-run the launcher and it should work!
Note, I ran Agent.524 first, not sure if that is a pertinent step or not, if it is, insert it before Agent.868.
If this works for you guys can you add it to the battle.net forums? I don't have a beta key.

Just tried this and with either of the Agents the dos just repeats saying "Response: 200" over and over and the Agent.exe process immediately returns when I launch one of the Agents in program data
Try rebooting the system into 'Safe Mode with Networking' (mash on F8 just before the windows logo comes up).
Run the launcher, it should update the tools. After that, the update will most likely freeze, if it does reboot back to normal mode.
Next time you run the launcher it should skip the 'Updating Tools' part and begin downloading the patch/update whatever it happens to be.
This is the only way I've ever been able to get by the "Stuck at 60% Updating Tools" issue.
Do you run a 64-bit OS? This seems to be a common trend.
EDIT: I would like to add that I personally have not had this issue since the last tools update (the one a few days ago, not patch 16). Not sure if they 'fixed' it or if my Windows finally 'just' started to let it work. Dunno...
Running on Vista 64-bit myself, and got into this problem too.
After being stuck for ages on the "Updating Game Files", I get the Launcher to Combability Mode (Win XP SP2), and did the same for the "Agent.exe" files in ProgramData (as described earlier). That is, after deleting them before trying it again.
The Launcher is now happily updating my files as it normally does on a Patch. However, I've not yet got into the game... stopped working when I launched the game. Starting over with trying to mark Updaters as well for Combability Mode. Let's see how that goes.

Update: I gave up, uninstalled the client, and trying to redownload and start over. Hoping it'll work like Scyber said :/
... sadly, it didn't seem to fix anything at all. The same problem persists.

Gnub have you tried to the re-install from Safe Mode w/ Networking? There were several occasions when this was the ONLY way I could get past the "Updating Setup FIles" bug.
