That poses a very compelling argument to the people that believe the trademark to be a refresh of the other Diablo games.
It says that filing method is used for marks that have never been used yet, but we all know D1 and D2 have been used. This means that the trademark is for D3... otherwise it wouldn't get special precedence.
As of now, science can only explain the synthesis of methane through organic processes involved with life. The second largest moon in the solar system, and the only moon surrounded with a dense atmosphere, Titan, is so packed with methane that it rains the stuff.
Although it is too cold at the surface, Titan does contain water, but the density of liquid methane is much lighter than even the coldest water. So if there is a lake of water deep within the crust of Titan, it will surely be covered with liquid methane.
This all leads me to believe that deep in the oceans of Titan there is liquid water, and in that water there are alien microorganisms producing methane.
I am confident that I saw an angel or ghost when I was 9 or 10. I am familiar with how powerful dreams can be, but this has only happened to me once. I was awoken by a loud humming sound and it was hovering above my bed. Whatever it was, angel or ghost, it was very vivid and colored green, red, and orange with sagging features all over (sagging like old people). It was only a few feet tall, but very loud. It scared me so hard I couldn't scream at first, but I finally overcame the fear and starting yelling out for my parents while hitting whatever it was (felt like hitting air). Hitting it made it fade away.
Needless to say I slept in my parents room for the next few months LOL. I finally put a lock on my closet and moved my bed right next to the door with the hall light on.
If my calculations are correct, we have 72 days 'till June 28--- not including today.
72 days= 72 days x 24 hours per day x 60 minutes per hour x 60 seconds per minute
= 6,220,800 seconds until they officially announce Diablo III.

But this could mean that some chinese company could push a game in less then a year that was absolutely crap and have the trademark ?
They would need to jump through so many loops it is nearly impossible (And Blizzard would already be familiar with such a company because Blizzard marked Diablo and Diablo 2 LOD). This stage is really just another bureaucratic process that needs to be done for the US Patent Office to be able to successfully defend the mark in court if needed.
Opposition has 30 days to file. Whether or not the trademark completes registration after the 30 days seems to be a different story. WOW took a full year while a few lesser titles were completed immediatly.
Lets just hope that this second expansion to WOW is the final. It is just unlikely that Blizzard will release D3 with WOW crapping out new content every year.
WOW was announced late '01, and released late in '04. The first expansion was announced late in '05 (1st blizzcon) and released early '07. The second was announced late '07 and might end up like the first being released early '09 (Guess).
If all goes smoothly with the latter model we might hear something late '09.
Both former models point to this year.
O well! who knows? .... Definitely not all the people that keep sending me PMs with their "Inside information" that is for sure...
I decided to check up on Diablo's trademark, and I noticed something I new.
It seems the trademark was "Published for opposition in early 2007, February 13th to be exact.
This means that any competition to the name Diablo now has a chance to oppose the trademark for whatever reason.
WOW was released a year after the name was published for opposition, but that doesn't seem to be the case for Diablo 3.
If there is no successful opposition it will become an official registered trademark and finally ready to be put for sale.
For a refresher, this trademark includes rights for a movie title: "ENTERTAINMENT IN THE NATURE OF AN ONGOING TELEVISION PROGRAM IN THE FIELD OF CHARACTERS AND PLOTS BASED ON A VIDEO GAME; AND PRODUCTION AND DISTRIBUTION OF MOTION PICTURES"; BUT it doesn't look like it will be titled "DIABLO II: SALVATION" as that trademark is now DEAD.
Read: DEAD, like Starcraft: Ghost! LOL (yes, that is officially dead Abandonment Date December 4, 2005)
I would also like to confirm Blizzard's plans on producing in-game communication software. Perhaps you head of this, but Battlechat - "Virtual network telecommunications services, namely, providing an interface for the electronic transmission of messages and data including voice, text, and message transmission" was filed at the USPTO on January 11, 2008
I have been getting PMs from new users that do not post in the forums.
They keep telling me that they have news about D3, but don't want it to get out to everyone yet.
I suspect that whatever it is, Blizzard is facing competition in 08 with God's and Heros and Warhammer online doing beta registration.
Warhammer has more than half a million already, so I would expect Blizzard to come up with something other than a WOW expansion.
I have read somewhere on d2.net that blizzard makes over a million bucks a day on WOW, it is almost evil. One would think that someone, or something, with all that cash would be able to expand at unimaginable rates, but no?

I like those icecream bars that have all three.

Amd this is their source (lol): http://forums.worldofwarcraft.com/thread.html;jsessionid=BC8F0682596A98B2FE1E8A8EA381AC0D?topicId=3168513730&sid=1&pageNo=1
IT IS OFFICIALLY CONFIRMED.
Edit: Well... calling it Diablo 3 is speculation because of the focus on the term 'unannounced title.'
For conversation's sake, what is a "Title" anyway?
