I have actually written a report on this kind of topic. You are semi-correct, it all comes down to the legitimacy of ownership of virtual items. In the past there have been many court battles with manufacturers losing a majority of them (look up Vernor v. Autodesk).But company's have gotten much smarter since then and if you read the very first lines of the EULA or TOU you will see a phrase of something like "this software is licensed and not sold."
This is basically the key reason: you DO NOT own anything in Diablo 3 If Blizzard f's up their servers and you lose your 200+ hour hardcore character, then you try to take Blizzard to court... well Blizzard can point to this very blatant statement at the top of their agreements (so you can't make a click/shrinkwrap argument) that you did not own that hardcore character and thus you can not sue them over something you don't own.

So one of the previews for update 1.0.3 is an increase in repair costs. There are a lot of people complaining about this, most did not read the blog entirely. To cover the main points:
The second misconception, this will cost players more than they can make, we will have to buy money just to play. Yeh right... First off if you are dying in an area consistently, as the devs have said, you are in the wrong area or you are doing something wrong. Secondly, you get 1 or 2 stacks of neph valor you can easily find 1k gold drops.
In other words if you have the right gear in the area you are adventuring, and not skipping every champion pack but actually beating them, you will still be fine... I like this concept it sticks with their objectives from the beginning.
There is also something else about this I REALLY like, it has do with as the devs called "graveyard zerging". As it is now, repair costs, to be honest, are nothing. You can find the money for repairs in a few minutes. If they buff it up 4x or 6x, yeh, repair costs start getting real expensive, up around 30k depending on your gear for full repair.
So this obviously is meant to kill graveyard zerginig right?
Well there is an interesting stat that can roll for any weapon or armor called: indestructible. We've taken this stat for granted, read over it as a crappy stat, due to the low repair costs, raise the repair costs and being Indestructible is now worth something (you can graveyard zerg all you want and avoid tens of thousands of repair costs each day) well that sounds pretty awesome, i think i want it on my items for the future.

THis. Also dont forget teammates will buff each other up. As for those "1 mil critical hits" Im not sure I have seen any video of that, i dont think its possible. 1 mil dps is possible but thats a whole other story... dps does not equal damage. And as for those class cannons, for anything they will be the ones getting one shotted.
Still I think if they get the matchmaking system right (supposed to match people based on gear and wins) pvp will be a lot of fun.
