Has anyone from AUS seen this? MAJOR BUMMER for all us guys who preordered our CE with GAME..... Apparently they don't even give you a refund, so if you payed in full up front there goes $137
Yeah, well I haven't been keeping up with the latest corporate videogame business news, so I didn't know what was going down. What a time to tell everyone they're not getting what they paid for months in advance, and more importantly that they WON'T be refunding anyone??
Apparently, and I only read this from a poster in the OP, they aren't actually legally obligated to refund anyone, because of some such term they used.
Sorry Aussie bros, that really sucks. I'd probably roid rage if Amazon were to cancel my CE that I'm patiently waiting on.
Yeah, I think they've already sent out the orders that were made online, but this same thing is happening with the CE, SE and any other game coming out in the near future e.g. Max Payne. That's a LOT of preorders to not be honouring....
I'd go down there an cause a scene, then take whatever i could of equal value to my pre-order if i had already paid in advance.
Haha yeah, I think I'd rather have the CE than $138 worth of stuff but I'm hoping mine comes in the mail tomorrow, if not I'll curl up in a corner and cry aggressively about the whole ordeal. Until about 4:30 (30 mins before servers go live in QLD) and then I'll order the digital copy and the rest.
If they don't give people a reimbursement on the money they spent, maybe they will let you spend the same amount of money on other items from the store. It would be better than nothing so its worth a shot. If the company had any amount of decency they would atleast do this.
I got friends who work at my local game, so I have known about this for a little bit. However I thought I was lucky I split my business between EB and Game. I ordered it the week it was announced, yet when I went into EB today they said that they ordered less CE then they had taken deposits for..
So now I gotta be there at 9 AM when the doors open to once again "secure" my CE in a "first in best dressed" even though its been payed out since announcement week.

We are still working to clarify the status of pre-orders. At this stage we are intending on honouring
certain pre-orders placed on the Diablo III and Max Payne new releases. We will provide clarity on

Their money? I thought it was the customers money. Are you suggesting that GAME gave the money to Blizzard and they won't give GAME the CE's or reimburse them? That has got to be illegal , I just can't see a publisher ripping off a distributor without breaking laws.
The money didn't just disappear someone is profiting off of this.
It's not a complex situation. You paid someone money, and they didn't deliver a service they promised in both written and verbal contract. NO MATTER WHAT they put in the fine print, it's null and void if the verbal agreement didn't acknowledge it at face value.
You take them to small claims court for the cost of the game + the court fees. You can do that. It's fun. It's not hard. The best part? They have to send someone to physically represent the company in court, which would cost more than to just pay you back, even if it's with credit.
Can't unless the Supreme Court gives the OK to sue. Apparently.
For all the shit America gets, at least we aren't legally gimped yet.
I sued Verizon over a cell data fee situation. They sold me a phone with a button on the front that you couldn't disable called "SPEND MO MONEY"; then my first bill was over $6,000. I got the price of the phone, the ETC, and a bullshit charge of "lost wages" due to having to hide from their collectors.
I never hid from their collectors. I just felt like taking a dump on them. So I told them over the phone in court you'll settle for X amount or else, and they dealt with it.
Can't unless the Supreme Court gives the OK to sue. Apparently.

It's written on pre-order reciepts that they are non-refundable. Sure it may be immoral, and in sticky situations or if someone changes there mind then giving the refund is a gesture of goodwill, but they can't refund. There is nowhere for the money to come from. PWC is in charge of admin for them now. It would be intersting to know if when the heads knew about the impending drop into administration, wether they told other staff, or wether they allowed their stores to continue to push for pre-orders that they knew they could not fulfill
