But this could mean that some chinese company could push a game in less then a year that was absolutely crap and have the trademark ?
They would need to jump through so many loops it is nearly impossible (And Blizzard would already be familiar with such a company because Blizzard marked Diablo and Diablo 2 LOD). This stage is really just another bureaucratic process that needs to be done for the US Patent Office to be able to successfully defend the mark in court if needed.

I remember before Diablo 2 came out that I would spend a lot of hours online (usually on diabloii.net) checking out unique items and such and getting more and more excited.
Years go by like nothing. I remember playing God of War back in 2005 and not being able to wait for the sequel, and 2 years went by just like that.
That poses a very compelling argument to the people that believe the trademark to be a refresh of the other Diablo games.
It says that filing method is used for marks that have never been used yet, but we all know D1 and D2 have been used. This means that the trademark is for D3... otherwise it wouldn't get special precedence.
